This is where we set out all the legal necessaries of who we are, how we do business and what your rights are, including what information we collect and how we store it. We appreciate it is a very long list of information so please feel free to simply give us a call on 01872 211866 if you have any queries.
Essentially we want you to be really happy with what you order from us and we will go above and beyond to ensure that you are. If anything goes wrong - and they can occasionally with any business - we will do everything can to put it right for you. We don't sell your information on, we are transparent about our supply chain, and we keep your personal data private.

Our Terms & Conditions
These terms and conditions cover your relationship with The Cornish Food Company Ltd (we, our, us) and all orders that you make with us. Please read these terms and conditions carefully as they affect your rights and liabilities under the law. In particular we draw your attention to terms 1.2, 4.1, 4.3, 5.3, 5.4 and 5.8.
We reserve the right to review and amend these conditions from time to time.

1: Account creation
1.1 You must be at least 18 years of age (or a business operated by someone at least 18 years of age) to open an account with us.
1.2 You must ensure that the details you provide are complete and accurate, including your delivery instructions as per 5.3.
1.3 Any change to your details must be notified to us promptly, either by updating your details via your account on the website or by calling our office.
1.4 You will be asked to create a password as part of the online account creation process. If your account is created over the phone a password will be generated for you and we recommend that this is changed immediately via the ‘log into your account’ section of our website. Your password must be kept confidential and you will be responsible for all activities that occur and all orders (including those for alcohol) that are submitted under its use.
1.5 You must notify us immediately if you know or suspect that someone knows your password and recommend that it is changed immediately via the ‘log into your account’ section of our website.
1.6 We reserve the right to require that you change your password and to suspend or cancel your account where we have reason to believe there has been or could be a breach of website security.
1.7 You will receive an email notification from us of your account set-up, please keep this email for your records.
1.8 The details you provide are governed by our privacy policy which is available on our website.
1.9 Your account with The Cornish Food Company Ltd is not a credit account and payment will be required when your order is processed.

3: Payment
3.1 You must ensure that The Cornish Food Company Ltd is supplied with a suitable and agreeable means by which to obtain payment. Details of how to pay can be found in the frequently asked questions section of our website.
3.2 We cannot accept any liability for how long it takes the banks to process your payment, by any means.
3.3 We reserve the right to refuse deliveries to you and to cancel your account where payment(s) have been withheld. You agree to compensate us in full for all reasonable costs and expenses (including legal costs) in obtaining payments that have not been made in accordance with these terms and conditions. We may apply interest to late payments in line with statutory regulations.
4: Ordering and Purchasing
4.1 You must be over the age of eighteen to purchase alcohol from The Cornish Food Company Ltd. If you have ordered alcohol from us and cannot be at home to take receipt of your delivery, it is your responsibility to ensure that a suitable person aged eighteen or older is there to receive the order. Anyone who appears to be under the age of 21 may be asked for proof of age and where such proof cannot be provided at the point of delivery The Cornish Food Company Ltd reserves the right to refuse delivery of alcohol. Such refusals will be credited in full, however, we will bear no liability for such refusal.
4.2 Orders placed with The Cornish Food Company Ltd may be subject to acceptance based upon a minimum spend, which are published on our website under ‘Delivery Information’. The Cornish Food Company reserves the right to alter the existing, or introduce new minimum spend conditions which will be published our website.
4.3 Any orders you make on the website will be automatically submitted to us at the order cut off times published in the ‘frequently asked questions’ on our website. You have the ability to alter, amend and cancel your order up until this cut off time and by allowing an order to be submitted to us you confirm that you have made any such corrections and cancellations and enter into a contract to buy the products from us. You cannot then cancel or withdraw your order, or any part of it except as per 6.3 below.
4.4 Where the removal of a product reduces your spend below a given minimum spend threshold (as per 4.2) then we reserve the right not to deliver your entire order. Orders placed below the minimum spend levels will only be available to be picked up from our shop or if delivered subject to a delivery charge based on delivery postcode. Details of these charges are available under ‘Delivery Information’ on our website. We will bear no liability for any delivery refusals.
4.5 No order placed online is accepted from us until our website displays an order confirmation message. You will receive an ‘order alteration’ email and this email should be kept for reference until your order has been delivered and accepted as correct.
4.6 While we will endeavour to deliver all accepted orders, our products are subject to availability and we do not always know if a product is, or will be available for delivery at the time of accepting an order. If we are unable to deliver an item you have ordered we may offer a reasonable substitute. You may reject this substitute and you will not be charged for it, or where payment has already been taken you will be refunded any amount paid for that item. Where we do not offer a substitute product the item will be removed from your order and again you will not be charged for it, or where payment has already been taken you will be refunded any amount paid for that item. We will bear no liability for the unavailability of our products.
4.7 All of the products that we offer are subject to variations in seasonal availability and supply price. You accept that the price to be paid for all items in your order will be that stated on the website at the time of the order submission as per 4.3.
4.8 Where an item has been displayed on our website with an incorrect, erroneous price we reserve the right to remove that item from your order, amend the price to one that is correct or to not deliver the item and refund the price paid.
4.9 All prices displayed on the website are inclusive of any applicable taxes and duty (including VAT).
4.10 You are entitled to cancel payment for products where there has been fraudulent use of your payment card (despite the above provisions). Where a fraudulent payment has already been made then you should contact your card issuer for credit back to your card.
5: Delivery and Delivery instructions
5.1 We will deliver to the delivery address stated in your The Cornish Food Company account (herein also referred to as “home”).
5.2 We reserve the right not to deliver to all locations, or not to deliver all products to all locations. You will be notified during the account creation process if we are unable to deliver to your address. Where we are unable to deliver to your address or certain products to your address we will inform you that they are unavailable for you to order (via the telephone or email).
5.3 It is your responsibility to make suitable arrangements to receive your delivery. The delivery details section of your account is important as it allows you to leave instructions of a suitable location where your delivery can be left if you are not at home to take receipt of the goods, which forms part of our contract under these terms and conditions. It is important that you provide a suitable means (at your own cost) to keep any goods we deliver that need to be refrigerated at a temperature below 8oC until such a time as you are able to refrigerate them.
5.4 Once your delivery instructions have been followed and completed by us, you will accept that you are in possession of the delivered goods. Where the delivery instructions have been followed; we will not accept any liability for damage to, or theft of your goods, nor will we accept any liability for any incidents which may arise as a result of the theft or damage to such goods (including alcohol).
5.5 You can select the delivery day your order will be delivered. We will endeavour to deliver on this day, however, we reserve the right to change it if necessary, and will notify you of any such changes.
5.6 The time that your order is delivered is dependent on traffic, weather and the number of deliveries to be made that day. We make no guarantee of the delivery time and accept no liability for inconvenience or loss as a result.
5.7 We cannot accept liability for any inconvenience or loss where we are unable to deliver to you, or deliver to you late for reasons beyond our control (e.g. adverse weather, vehicle breakdown, traffic congestion, strike actions, supplier failures). We will of course refund you for any part of your order which is not delivered or which has been compromised as a result of the delay.
5.8 To minimise our carbon footprint The Cornish Food Company reserves the right not to provide a printed receipt with your delivery. Your delivered goods and their value can be viewed online via your Cornish Food Company account.
5.9 You must inspect your goods as swiftly as possible after delivery and notify us promptly of any errors. We will refund you for any products you receive that were not ordered, are faulty, have been substituted with a product that is unacceptable to you or that were delivered without us following these terms and conditions. However, such liability will be limited to the value of the erroneous and / or undelivered goods.
6: Cancellation
6.1 You may cancel your account with us at any time either online or by notifying us in writing, over the phone or by email. Suspending or cancelling your account will not affect or remove any rights or liabilities accrued up until that point and any orders submitted (as per 4.3) prior to your account cancellation will remain binding.
6.2 The Cornish Food Company may cancel your account and or any accepted orders at our reasonable discretion or if you breach any of your obligations under these terms and conditions.
6.3 With the exclusion of perishable goods, our customers who are consumers (e.g. those ordering outside of the course of their business or trade) have the right to cancel their order at any time until the expiry of the seventh day after the date of delivery. This can be done by notifying us by telephone, email or post. We may request the return or collection of these goods and refund you the price paid for them less our reasonable costs in collecting the goods.
7: Warranties & applicable law
7.1 We guarantee that our products will be of a satisfactory condition and quality (with the exception of defects caused by your mis-use, neglect or by accidents while the goods were in your possession). Please notify us if you are dissatisfied with any of our products. If upon examination they are defective or faulty we will gladly refund you the price paid for them.
7.2 We accept no liability in relation to representation, including unforeseeable losses and losses to a business (loss of reputation, profits, trade or trade opportunities).
7.3 Our entire liability under these terms and conditions will not exceed the purchase price of the goods in question. This excludes the provisions we’ve made under 5.10 in relation to holding your keys. Also, nothing in these terms and conditions can limit our liability to you death or personal injury resulting from our negligence or that of our employees, agents or subcontractors.
7.4 We shall not be liable for any delay or failure in the performance of our obligations due to events beyond our reasonable control such as but not limited to fire, adverse weather, acts of God, strikes, labour disputes, civil unrest, accident, disruption to energy supplies, equipment or supplier failure, road traffic problems, terrorism or war.
7.5 You are not entitled to assign, sub-license or otherwise transfer any of your rights under these terms and conditions.
7.6 These terms and conditions are governed by and construed in accordance with British law and the British courts will have no-exclusive jurisdiction over any disputes which arise in relation to these terms and conditions.
7.7 If any of the provisions in these terms and conditions are found to be invalid by a court having jurisdiction, then the invalidity of that provision will not affect the validity of any other provisions within these terms and conditions.

Competition Terms and Conditions
General
1: These terms and conditions, together with the terms and conditions that are specific to any Competition (as defined below) (the 'Competition Terms') are known as the 'Rules'. Words used in the Competition Terms shall have the same meaning when used here. In the event of any conflict between the Competition Terms and the Standard Terms, the Competition Terms shall prevail.
2: The Rules apply to any competition (the 'Competition') that is promoted Station by or on behalf of The Cornish Food Company Limited of 32 Cardrew Trade Park, TR15 1SS (' The Cornish Food Company Ltd') and by entering the Competition, you agree to be bound by the Rules.
3: The Cornish Food Company Ltd reserve the right to cancel or amend all or any part of the Competition and/or the Rules without notice for any event that is outside of The Cornish Food Company Ltd's reasonable control. Any changes to the Rules, or cancellation of the Competition, will be posted on The Fine Food Hamper Facebook Page and or website. It is the responsibility of entrants to keep themselves informed as to any changes to the Rules.
4: In the event of any dispute regarding the Rules, the conduct or results of the Competition, or any other matter relating to a Competition, the decision of The Cornish Food Company Ltd shall be final and unchallengeable and no correspondence or discussion shall be entered into, comment issued, or reason given in respect of any decision made by The Cornish Food Company Ltd.
Competition Entrants
5: By entering the Competition, you hereby warrant that all information submitted by you in your Entry is true, accurate and complete in every respect. The Cornish Food Company Ltd reserves the right to verify any information contained in your Entry and/or your eligibility to enter the Competition.
6: Unless otherwise stated in the Competition Terms, the Competition is only open to persons who are resident in the United Kingdom and persons who are resident outside of the United Kingdom may not apply. Where a Competition is open to persons who are resident outside of the United Kingdom, no person may enter the Competition if the Competition breaches any law or regulation of the jurisdiction in which they are resident.
7: Unless otherwise stated in the Competition Terms, the Competition is only open to persons 18 or over.
8: The Cornish Food Company Ltd reserve the right in its absolute discretion to disqualify any entrant if it has reasonable grounds to believe that an entrant has breached any of the Rules, any applicable law (including copyright law) or has otherwise infringed the intellectual property of any other person. Each entrant acknowledges and agrees that any failure to comply with the Rules could lead to The Cornish Food Company Ltd disqualifying that person, without The Cornish Food Company Ltd giving any reason for such disqualification or granting any opportunity for challenge.
9: Any person that is: (a) an employee of any company involved in the Competition (including The Cornish Food Company Ltd); or (b) a family member of such employee, is not eligible to enter the Competition. The Cornish Food Company Ltd reserves the right to disqualify any person that it knows is, or has reasonable grounds to believe is, ineligible for the Competition as a result of this Rule.
10: In the event that a Prize-winner is disqualified from the Competition or is unable to accept the Competition prize, The Cornish Food Company Ltd will, unless otherwise stated in the Competition Terms, select an alternative Prize-winner in the same manner as the original Prize-winner and such selection will be subject to the Rules.
Competition Entries
11: Entries must be made by the Closing Date and in the manner set out in the Competition Terms. Failure to do so will result in disqualification.
12: There is no requirement to make any purchase in order to enter the Competition or access the website.
13: Unless otherwise stated in the Competition Terms, only one Entry per person is permitted. In the event that The Cornish Food Company Ltd discovers or has reasonable grounds to believe that the same person has made multiple Entries, such person and any Entries made by them shall be disqualified and, if such Entrant has already been selected as a Prize-winner, an alternative Prize-winner will be selected in accordance with Rule 10 above.
14: Unless otherwise set out in the Competition Terms, The Cornish Food Company Ltd accepts no responsibility for the return of any Entries.
Prize-winners
15: Prize-winners will be selected and notified in the manner set out in the Competition Terms. No prize will be awarded where any entrant has committed any form of misconduct (as determined by The Cornish Food Company Ltd in its sole discretion).
16: Where Entries are judged on artistic or other subjective criteria, The Cornish Food Company Ltd reserves the right to set amend the criteria used to judge Entries.
17: Prizes are non-transferable and there is no cash alternative. In the event of a prize being unavailable for any reason The Cornish Food Company Ltd reserve the right to substitute prizes of equal or greater value at any time.
18: Prizes must be accepted in the manner set out in the Prize Notification. In the event that any Prize Notification is returned as undeliverable or any Prize-winner fails to validly reply to a Prize Notification within 28 days, The Cornish Food Company Ltd reserves the right to disqualify the Prize-winner and select an alternative Prize-winner in accordance with Rule 10 above.
Liability
19: The Cornish Food Company Ltd accepts no responsibility for any damage, loss, injury (other than our liability for personal injury or death as a result of our negligence) or disappointment of any kind suffered by any entrant in entering the Competition, including as a result of any entrant winning or not winning any prize.
20: The Cornish Food Company Ltd accepts no responsibility for Entries lost, damaged or delayed in the post, or due to computer error in transit. Entries made online using methods generated by a script, macro or the use of automated devices will be void.
Intellectual Property Rights and Data Protection
21: You agree that The Cornish Food Company Ltd (and any third party authorised by The Cornish Food Company Ltd) may use your Entry (whether or not it wins the Competition) for any promotional purpose (for example, placing it on our website or on any poster, leaflet or other advertising media). You confirm that your Entry is original that you own and have the right to license to The Cornish Food Company Ltd the copyright and other intellectual property rights in the Entry for the purposes referred to in these Rules. You will retain ownership of copyright in your Entry but you give The Cornish Food Company Ltd (and any third party authorised by The Cornish Food Company Ltd) your irrevocable permission to use, reproduce, publish, display, transmit, copy, amend, store, sell and sub-licence your Entry worldwide for such promotional purposes and for the purposes of the Competition.
22: The Cornish Food Company Ltd will use any personal information that you provide with your Entry for the purposes of the Competition and, where you have given your consent, for marketing purposes including the distribution of regular email updates or newsletters. Any personal information relating to entrants will be used solely by us in accordance with applicable data protection legislation.
23: All Prize-winners unconditionally agree (as a condition of accepting any prize) to: (a) the use of their name, one or more photographs of themselves and disclosure of their county of residence (if such Prize-winner is resident within the UK) or country of residence (if such Prize-winner is resident outside the UK); and (b) co-operate with or participate in any other reasonable post-Competition publicity.
Governing Law and Jurisdiction
24: The Rules and any dispute or claim arising out of or in connection with them or their subject matter (including the Competition), existence, negotiation, validity, termination or enforceability (including non-contractual disputes or claims) shall be governed by and construed in accordance with English law.
25: The Courts of England shall have exclusive jurisdiction in relation to any dispute or claim arising out of or in connection with the Rules or their subject matter, existence, negotiation, validity, termination or enforceability (including non-contractual disputes or claims).
